Terms and Conditions of Use for Cliggs

We are Cliggs SpA, hereinafter referred to as Cliggs or Cliggs.tv, and based in Santiago de Chile.
At Cliggs, we provide an online platform that allows our users to automatically clip gameplay videos provided by them, share game clips and videos, and access the best content shared by the gaming community within a safe and friendly environment through our related products and services (collectively: the Services). We enable users to interact with each other through clips, "likes," and comments. Our services are offered through our mobile application and our website: Cliggs.tv.
These Terms of Service (the Terms) govern the relationship between Cliggs and the users of the Services. The use of the Services is conditioned upon the acceptance and compliance with these Terms. Cliggs may modify these Terms from time to time. The latest version of the Terms applies to the relationship between Cliggs and the user.
Who Can Use Cliggs
1.1 You may use our Services only if you can form a binding contract with Cliggs, and only in compliance with these Terms and all applicable laws.
1.2 When you create your Cliggs account, you must provide us with accurate and complete information. Please read our Privacy Policy. Use or access by anyone under the age of 13 (thirteen) is prohibited.
Registration and Account
You may create an account via email or third-party platforms like Discord, Google, Facebook, Apple, Instagram, Twitch, TikTok, or Kick. An account gives access to more platform features.
Without an account, you can access Cliggs.tv and the mobile app in a limited way: you can view video clips but cannot interact or upload content.
You must choose a password of at least 8 characters and are fully responsible for keeping your credentials secure.
You agree to provide only accurate and complete information. Cliggs is not responsible for incorrect account data.
If your account is blocked or deleted, you lose access. Attempts to reaccess will result in new accounts being blocked or deleted.
You may not let unauthorized third parties use your account.
If using the Services on behalf of an entity, "you" includes both you and the entity.
These Terms apply to all current and future versions unless otherwise stated.
We reserve the right to refuse our Services to anyone and may suspend, block, or delete your account in cases such as DMCA notices, Terms violations, fraud, abuse, or misconduct.
(Prohibited) Use of the Platform
3.3 Do not use the Services to:
- Infringe on intellectual property
- Violate privacy
- Send unsolicited messages
- Engage in illegal or rights-infringing activities
- Submit fabricated, staged, pre-recorded outside of gameplay, edited, or spliced content as a genuine gameplay clip or Event submission
- Use bots, scripts, purchased engagement, multiple accounts, or any other artificial means to inflate views, likes, comments, or follower counts
- Attempt to influence the outcome of an Event or Challenge through fraud, manipulation, or misrepresentation
3.4 Violations may result in account termination and deletion of related data.
Intellectual Property and User-Generated Content
Cliggs owns all intellectual property related to the Platform and Services.
Subject to these Terms, Cliggs grants you a limited, non-exclusive, non-transferable, revocable license to use the Services.
You retain rights to your user-generated content but are responsible for it and must ensure you have proper authorization.
Clips submitted as entries to an Event or Challenge are subject to the same content license granted under Sections 4.4–4.6, in addition to any Event-specific rules published for that Event.
You grant Cliggs a broad, global, royalty-free, irrevocable license to use your content for operation, promotion, and marketing.
This includes redistribution via third parties.
This includes the right for Cliggs to publish your clips or gameplay recordings on Cliggs' own social media accounts (such as Instagram, TikTok, YouTube, X, and Discord) to promote the platform and its community.
Cliggs may remove content violating these Terms or laws. Reportable via the platform or DMCA procedures.
Cliggs is not responsible for user content and disclaims liability for its accuracy or appropriateness.
Content may persist in backups or where shared by others, even after deletion.
Cliggs will automatically delete gameplay recordings and associated clips older than 90 days. Users are responsible for downloading any content they wish to keep before this period expires.
Events, Challenges, and Prizes
From time to time, Cliggs may run Events, Challenges, or similar promotions ("Events") through the Clips page, inviting Users to submit video clips for a chance to win a prize. Each Event has its own published rules covering the prize, eligibility, submission requirements, activation threshold, duration, and winner-selection method (the "Event Rules"). Event Rules form part of these Terms and apply in addition to them. In case of conflict, the Event Rules for that specific Event control.
Unless an Event's published rules state otherwise, participation is free and does not require any purchase.
Users must meet the eligibility criteria stated in the applicable Event Rules, which may include a minimum age, account verification status, and following specified Cliggs social media accounts. Cliggs may verify eligibility manually or through automated means and may disqualify entries that do not meet these criteria at any point before, during, or after the Event.
Each Event requires a minimum number of valid participants, as stated in its Event Rules, to be activated. If this threshold is not met by the Event's end date, Cliggs may cancel the Event, and any stated prize will not be awarded for that Event, unless the Event Rules specify that it rolls over to a future Event.
Winners are determined using the method stated in the applicable Event Rules (e.g., combined views and likes during the Event window). Cliggs' determination of the winner is final. Cliggs reserves the right to disqualify any entry it reasonably believes violates these Terms, the Event Rules, or applicable law, including entries obtained through manipulated engagement.
Events that require following Cliggs' accounts on third-party platforms (such as Instagram or YouTube) are administered solely by Cliggs. These Events are not sponsored, endorsed, administered by, or associated with Instagram, YouTube, Meta, Google, or any other third-party platform referenced in the Event Rules.
Prizes will be delivered using the method and within the timeframe stated in the applicable Event Rules. If a winner cannot be reached or does not respond within the stated period, Cliggs reserves the right to award the prize to the next-eligible entrant or to withdraw the prize, as stated in the Event Rules.
Winners are solely responsible for any taxes or duties associated with receiving a prize.
Payments and Billing
Cliggs offers subscription plans that unlock premium features, including increased streaming targets, higher clip-generation limits, and priority processing. The features included in each plan are described on our pricing page and may be updated from time to time.
All payments are processed through PayPal. By completing a purchase you agree to PayPal's Terms of Service and Privacy Policy, available at paypal.com. Cliggs does not store your credit card number, bank account details, or any other sensitive financial credentials.
Subscription fees are charged in US Dollars (USD) unless otherwise stated at checkout. Any applicable taxes, duties, or levies imposed by the laws of your country or jurisdiction are your sole responsibility and are in addition to the stated subscription price.
Cliggs reserves the right to change subscription pricing at any time. Where permitted by law, we will give you at least 30 days' notice of a price change before it takes effect. Continued use of the Service after a price change constitutes acceptance of the new price.
Free trials, if offered, automatically convert to a paid subscription at the end of the trial period unless you cancel before the trial expires. You will not be charged during a free trial.
Payment Failures
If a payment fails, Cliggs may attempt to reprocess the charge. Access to premium features may be suspended until payment is successfully collected.
Repeated payment failures may result in downgrade to a free plan or account suspension at Cliggs' discretion.
Refund Policy
All purchases are final. Due to the digital and immediately consumable nature of our Services, we do not offer refunds except where required by applicable law.
If you believe you have been charged in error, you must contact us at contact@cliggs.tv within 30 days of the charge. We will investigate and, if an error is confirmed, issue a refund or credit at our discretion.
Filing a chargeback or payment dispute with PayPal or your bank without first contacting Cliggs constitutes a breach of these Terms and may result in immediate suspension or permanent termination of your account, as well as recovery of any amounts owed.
Refunds, where granted, are processed through PayPal and may take 5–10 business days to appear depending on your payment method and financial institution.
Auto-Renewal and Cancellation
Subscriptions renew automatically at the end of each billing period (monthly or annual, as selected at purchase) until cancelled. You authorise Cliggs to charge the applicable subscription fee to your PayPal account on each renewal date.
You may cancel your subscription at any time through your Cliggs account settings or directly through your PayPal subscription management page. Cancellation takes effect at the end of the current billing period; you will retain access to premium features until that date.
No prorated refunds are issued for unused time remaining in a billing period after cancellation.
Cliggs may suspend or terminate your access to paid features if we are unable to process payment on the renewal date, following reasonable notice.
Limitation of Liability
9.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLIGGS IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR ANY OTHER INTANGIBLE LOSS RESULTING FROM:
- Access or inability to use services
- Device damage
- User or third-party behavior or content
- Unauthorized account access or content alteration
- Events beyond our control (e.g., network failures)
9.2 IF CLIGGS IS FOUND LIABLE, LIABILITY IS LIMITED TO $100.
Indemnification
10.1 You agree to indemnify Cliggs and its affiliates against any claims arising from:
- Breaches of these Terms or Community Guidelines
- Misuse of the Services
- Legal violations or rights infringement by you or users of your account
Dispute Resolution, Law and Jurisdiction
These Terms are governed by Chilean law.
Disputes should first be addressed informally. If unresolved, they will be subject to the courts of Santiago, Chile, unless otherwise required by law.
Nothing prevents either party from seeking equitable or injunctive relief for data, IP, or access issues.
